RESTITUCION DE BIENES POR PETICION DIRECTO. El dueño, poseedor o tenedor legítimo de los bienes aprehendidos durante la investigación y que no deban pasar a poder del Estado o ser destruidos, podrá solicitar su restitución ante el juez o funcionario de instrucción. Comprobada la propiedad, posesión o tenencia del solicitante, se ordenará la entrega, previo avalúo o peritaje técnico si fuere necesario. De tal entrega se levantará acta en que así conste.
