Si el litigante a quien se ha concedido término extraordinario, no presenta la prueba dentro de ese plazo, se le condena en la sentencia definitiva a pagar a su contrario una indemnización de ciento cincuentaa trescientos pesos, a juicio del Juez, excepto si aparece que no ha habido culpa de su parte.
