Siempre que un superior conozca de un asunto por apelación o consulta, y haya de revocar o reformar la providencia del inferior, dictará el fallo de modo que en él se resuelva el punto y no tenga que volverlo a decidir el inferior; pero si éste hubiere pretermitido una formalidad indispensable para fallar, se limitará a revocar la providencia para el solo efecto de que se cumpla la formalidad pretermitida.
