Impedimento Del Fiscal General Penal Militar

Si el Fiscal General Penal Militar se declarare impedido o no aceptare la recusación, enviará la actuación a la sala penal de la Corte Suprema de Justicia para que resuelva de plano.

Si prosperare el impedimento o la recusación continuará conociendo de la actuación uno de los fiscales ante el Tribunal Superior Militar.

Parágrafo

Impedimento de los Fiscales Penales Militares. De los impedimentos de los Fiscales Penales Militares ante el Tribunal Superior Militar conocerá el Fiscal General Penal Militar. De los impedimentos de los Fiscales Penales Militares ante la primera instancia conocerán los Fiscales Penales Militares ante el Tribunal Superior Militar.
