DEFINICION. Tercero incidental es toda persona natural o jurídica que, conforme al régimen de derecho penal y civil, sin estar obligada a responder patrimonialmente por razón del hecho punible, tiene un derecho económico afectado dentro del proceso. El tercero incidental podrá, personalmente o por intermedio de abogado, ejercer las pretensiones que le correspondan dentro del proceso penal militar.
