Art. 5º. El año comprensivo de incompatibilidades, adicional al periodo "De las funciones" de los miembros del Congreso de que habla el artículo 109 de la Constitución, empieza a contarse desde que termine el ejercicio efectivo de dichas funciones, esto es, desde el día en que se cierre la última legislatura ordinaria o extraordinaria del periodo parlamentario respectivo.
