El artículo 1249 del Código Civil quedará así:

“Artículo 1249. Legítimas efectivas. Acrece a las legítimas rigurosas toda aquella porción de los bienes de que el testador ha podido disponer con absoluta libertad, y no ha dispuesto, y si lo ha hecho ha quedado sin efecto la disposición.

Aumentadas así las legítimas rigurosas, se llaman legítimas efectivas.

Este acrecimiento no aprovecha al cónyuge sobreviviente, en el caso del artículo 1236 inciso 2 ° ”.
