El artículo 38 de la Ley 906 de 2004 tendrá un parágrafo segundo del siguiente tenor:

Parágrafo 2

Los jueces penales del circuito y penales municipales conocerán y decretarán la extinción de la sanción penal por prescripción en los procesos de su competencia.
