Se entiende por comercio clandestino de esmeraldas la venta, dentro ó fuera del país, de esmeraldas en bruto que no vayan acompañadas de una guía expedida por el ministerio de Hacienda, en la cual se expresará el nombre de quien la vende, el lugar de procedencia de las piedras y la manera como diga que las obtuvo el que solicite la guía.
