Garantía de seriedad de la oferta . En los procesos de contratación cuya cuantía sea igual o superior al .001 salarios mínimos legales mensuales vigentes, los oferentes deberán constituir una garantía de seriedad mediante garantía bancaria o de Compañía de Seguros, debidamente constituida y autorizada para funcionar en Colombia, que respalde las condiciones y términos de la propuesta. Cuando la cuantía de la contratación sea inferior a la señalada en el inciso anterior, el representante legal de acuerdo con la naturaleza del contrato, determinará la conveniencia de la constitución de esta garantía.
