° La fianza con que los Habilitados aseguran los fondos de su manejo, puede ser personal, hipotecaria ó prendaria. En el caso de ser personal, los fiadores serán individuos de reconocida solvencia, á juicio del funcionario encargado de aceptarla. Si fuere prendaria por el encargado de aceptar la fianza y por uno de los vecinos más respetables del respectivo lugar. Cuando se asegure con fincas raíces, deberá comprobarse la propiedad de éstas, ó la facultad que se tenga para hipotecarlas, la libertad de ellas y su valor libre debiendo igualar éste, lo mismo que el de la prenda, al de la fianza exigida y la mitad más.
