Respecto de los procesos en que el auto de proceder se hallare ejecutoriado, habrá lugar a la acumulación:

Cuando contra un mismo procesado se estuvieren siguiendo dos o más juicios, y

Cuando estén cursando dos o más juicios penales y no pueda decidirse sobre uno de ellos sin que se haya fallado el otro u otros.
