Los contratos o permisos de que trata el presente Código requerirán para su validez la aprobación del Presidente de la República, oído el dictamen del Consejo Nacional de Petróleos, y previo concepto favorable del Consejo de Ministros, y la declaración hecha por el Consejo de Estado de que se ajustan a las disposiciones legales. Cumplidos estos requisitos se elevarán los contratos a escritura pública.
