Art. 1451. No dona el que repudia una herencia, legado o donación, o deja de cumplir la condición a que está subordinado un derecho eventual, aunque así lo haga con el objeto de beneficiar a un tercero.

Los acreedores, con todo, podrán ser autorizados por el Juez para sustituirse a un deudor que así lo hace, hasta concurrencia de sus créditos; i del sobrante, si lo hubiere, se aprovechará el tercero.
