º . Del título de propiedad idóneo. Con fundamento en el acto administrativo ejecutoriado de que trata el artículo 2º del presente decreto, el representante legal de la entidad interesada elevará petición ante el Gobernador o el Alcalde Municipal o Distrital cuando se trate de bienes fiscales urbanos o, cuando se trate de bienes baldíos, se dirigirá al Instituto Colombiano de Desarrollo Rural, Incóder, quienes tendrán un término de diez (10) días hábiles para producir la resolución de transferencia de dominio, la cual deberá contener la identificación del inmueble a titular, quedando obligada la entidad pública beneficiada con la misma, a registrarla ante la Oficina de Registro de Instrumentos Públicos competente, dentro de los cinco (5) días hábiles siguientes a su expedición.
