Sin perjuicio de la investigación penal a que hubiere lugar, la corporación o funcionario que haya hecho la designación podrá en cualquier tiempo, de oficio o a solicitud del Ministerio Publico o de cualquiera persona, separar del cargo de plano, hasta que se pronuncie la decisión disciplinaria, a quien haya entrado a ejercerlo con fundamento en certificación o declaración manifiestamente apócrifa.
