Puede sustituirse un patrimonio de familia por otro, pero si entre los beneficiarios hay mujer casada o menores, el marido o el constituyente no puede hacer la sustitución sin licencia judicial previo conocimiento de causa.
La escritura pública respectiva debe inscribirse en el libro especial de que trata el artículo 18, dentro del término de los noventa días señalados en el mismo texto.
