° Sea cual fuere la naturaleza de la fianza ella se establecerá por escritura pública, haciendo constar que se constituye sin perjuicio de la general de los bienes del otorgante y fiador, y no sólo por la suma de la fianza sino por cualquiera otra de que resulte responsable el Habilitado, aunque sea superior á la afianzada.
