amends ley 418/97

El artículo 39 de la Ley 418 de 1997 , prorrogada por la Ley 548 de 1999 , quedará así:

Artículo 39. El establecimiento de crédito podrá hacer efectivo ante el Fondo Nacional de Garantías, FNG, o la entidad financiera de naturaleza oficial señalada por el Gobierno Nacional, el certificado de garantía correspondiente para que se le reembolse el saldo a su favor, siempre y cuando, además de cumplir las condiciones que se hayan pactado, acredite al fondo que adelantó infructuosamente las actuaciones necesarias para la recuperación de las sumas adeudadas.
