CIRCUNSTANCIAS DE ATENUACION. Si dentro de los tres meses siguientes a la fuga, el evadido se presentare voluntariamente, la pena prevista en el artículo 232 de este código se disminuirán hasta en la mitad. En la misma proporción se disminuirá la pena al participe de la fuga que, dentro de los tres meses siguientes a la evasión, facilite la captura del fugado o logre su presentación ante autoridad competente.
