Cuando cualquier Agente del Ministerio Público sepa que en el territorio a que extiende sus funciones se ha cometido una infracción de aquellas en que debe procederse de oficio, dará inmediatamente aviso al respectivo funcionario de instrucción, suministrándole todos los datos sobre la infracción y sus autores.

Este aviso puede darlo verbalmente o por escrito. Si lo diere verbalmente, se extenderá una diligencia que firmarán el Agente del Ministerio Público, el funcionario instructor y su secretario.
