Insubsistencia de un empleado de carrera. El nombramiento del empleado de Carrera Administrativa, deberá declararse insubsistente por la autoridad nominadora, cuando haya obtenido una calificación no satisfactoria en la evaluación del desempeño del empleo. Esta clase de desvinculación del servicio, será causal de inhabilidad para desempeñar cargos en la Procuraduría General de la Nación por el término de un (1) año. Contra el Acto Administrativo que declare la insubsistencia, procederán los recursos de ley, con los cuales se entiende agotada la vía gubernativa.
