Cuando el Gobierno no haya establecido en un Departamento Colonias Penales, Agrícolas o de otro género, según lo ordena la Ley 62 de 1912 , para los condenados por delitos de los de que trata el artículo 1° de dicha Ley, y de los que agrega el artículo 1° de la Ley 54 de 1913 , y el Departamento tenga a bien establecerlas y sostenerlas con sus propios recursos, el Gobierno podrá disponer que allí cumplan su pena los condenados por aquellos delitos o infracciones cometidos en el mismo Departamento.
