Artículo tercero. Cuando se acumulen dos O más juicios pendientes contra él mismo procesado y en alguno de ellos deba intervenir el Jurado, conocerá el Juez que tenga competencia para convocarlo. Si los diversos delitos estuvieren sometidos a la misma competencia, conocerá el Juez del proceso en que primero se haya ejecutoriado el auto de proceder. Cuando en un proceso se haya dictado sentencia de primera instancia no habrá lugar a la acumulación.
