El Síndico de la Penitenciaría Central, podrá tomar la totalidad de la suma de cuarenta pesos ($ 40) que se le señala como sobresueldo en el Decreto 671 de 1925, por las funciones que anteriormente se le habían adscrito, de cualquiera de las cajas de que habla en el artículo 1° del mencionado Decreto, cuando los fondos de una de dichas cajas se hallen totalmente agotados o no alcancen a cubrir la mitad de la expresada suma.
