La obligación de vender al Banco de la República las divisas correspondientes al reembolso o transferencia hechos en violación del artículo 25 y la sanción de multa prevista en el artículo anterior, serán impuesta en resolución del Superintendente de Comercio Exterior, debidamente motivada y apelable en el efecto suspensivo ante el Ministro de Fomento. Ejecutoriada la providencia del Ministro o la del Superintendente cuando no se interponga el recurso de apelación, quedará agotada la vía gubernativa, y el interesado podrá recurrir ante la jurisdicción de lo Contencioso Administrativo, conforme a las normas generales de la Ley 167 de 1941 y disposiciones concordantes.
