La muerte del inculpado extingue la acción penal. La del condenado extingue los efectos de la sentencia, aun en lo concerniente a la pena pecuniaria que no se haya pagado; extingue, además, todas las consecuencias penales de la condenación misma, pero no impide que se lleve acabo el decomiso.
