Los auditores de guerra tienen facultad para asistir a la práctica de las diligencias sumarias, deben concurrir a los Consejos de Guerra y dictaminar en todos los negocios que sometan a su consideración los funcionarios de instrucción, los encargados de ejercer la jurisdicción penal militar y el Inspector General de las Fuerzas Militares. Los conceptos de los Auditores de Guerra no son obligatorios.
