No habrá lugar a la legalización de explotaciones mineras cuando a juicio de la autoridad ambiental no sean viables, y/o cuando a juicio de la autoridad minera delegada sean manifiestamente inseguras, presenten peligro inminente para la vida de los mineros o de los habitantes de las zonas aledañas.
