Los Gobernadores de los Departamentos se posesionarán ante las Asambleas Departamentales, y en su defecto, ante el respectivo Tribunal Superior, residente en el lugar.

En casos graves y excepcionales, pueden posesionarse ante cualquier empleado que ejerza jurisdicción o ante dos, testigos. Los Secretarios se posesionarán ante el Gobernador, y los subalternos de la Gobernación, ante el Secretario de quien dependan.
