Sin prejuicio de lo dispuesto del Artículo 124 y 125 del decreto- Ley 522 de 1971 (Artículo 208, ordinal 5, y 214, ordinal 3; del Código Nacional de Policía) quién destine mueble o inmueble para que allí se use alguna de las drogas o sustancias a que se refiere el Artículo 38, autorice o tolere en ellos tal uso, incurrirá en presidio de dos a ocho años Esta sanción se aumentará hasta en la mitad y se impondrá multa de cinco mil a cien mil pesos, si el agente se propusiere un fin de lucro.
