Cuando por haber pasado la madre a otras nupcias se dudare a cuál de los dos matrimonios pertenece un hijo, i se invocare una decision judicial, el Juez decidirá tomando en consideracion las círcunstancias i oyendo además el dictámen de facultativos, si lo creyere conveniente.
