Sobre el personal militar que se desempeñe como Director o Gerente de entidad adscrita o vinculada al Ministerio de Defensa Nacional o sus equivalentes, así como el Jefe de la Casa Militar, conocerá de cualquier tipo de falta, el oficial más antiguo que preste sus servicios en el Ministerio de Defensa Nacional, siempre y cuando ostente mayor antigüedad y jerarquía que el presunto investigado, de lo contrario, conocerá el Jefe de Estado Mayor Conjunto del Comando General de las Fuerzas Militares. En todos los casos la segunda instancia corresponderá al Comandante General de las Fuerzas Militares.
