Además de los casos generales, en que de acuerdo con este Código no hay responsabilidad por los delitos, no son responsables del delito de deserción. 1°. Los que no hayan recibido instrucción sobre las leyes penales militares en cuanto a deserción se refiere. 2°. Los menores de dieciséis años. 3°. Los que sobrepasaren el límite máximo de edad para tener obligación de servir en las Fuerzas Militares.
