DE LA APLICABILIDAD DE LAS NORMAS PENALES A LOS MIEMBROS DE LAS JUNTAS. Por cuanto ejercen funciones públicas y se hallan encargados de la prestación de un servicio público y del manejo de fondos o rentas oficiales, a los miembros de las Juntas o Consejos que no tienen por este hecho la calidad de empleados públicos, les son aplicables las disposiciones del Título III del Código Penal sobre "Delitos contra la Administración Pública". A quienes tengan la calidad de funcionarios o empleados públicos, se aplicarán las disposiciones penales previstas para éstos.
