Cuando los objetos materia del contrabando fueren fungibles, podrá hacerse el remate hasta dentro del tercero día de la aprehensión para evitar el deterioro o pérdida de la mercadería, y cuando hayan empezado a deteriorarse se rematarán inmediatamente en postura libre. En estos casos se prescindirá de los anuncios en periódicos.
