Las personas o empresas que capten ahorro por el sistema de capitalización o similares con destino a planes de vivienda sin celebrar, simultáneamente con el contrato de capitalización, el de promesa de venta o el de compra-venta relativo un inmueble determinado, estará obligadas a constituir y mantener reservas que les permitan asumir los riesgos naturales de los negocios de su objeto y atender las obligaciones contraídas.

Las reservas se calcularán de acuerdo con las normas que establezca la Superintendencia Bancaria.
