Artículo décimo. Para la imposición de las sanciones anteriores, los funcionarios competentes procederán de oficio en virtud de denuncia. En tales casos se hará comparecer inmediatamente al presunto responsable, quien deberá presentar sus descargos dentro de los tres días siguientes, y podrá quedar detenido por un lapso que no excederá de dicho término de tres días, siempre que hubiere una prueba escrita o un indicio grave de la infracción. Vencido este término, el funcionario dictará la providencia respectiva. Sin embargo cuando el infractor fuere sorprendido infragante, la sanción se aplicará de inmediato.
