Si durante la investigación no se hallare al presunto infractor, se le emplazará por edicto que permanecerá fijado el término de diez días en la Secretaría. Transcurrido este plazo sin que concurra, se le nombrará curador ad lítem y con él se continuará el diligenciamiento hasta su terminación.
