En el auto en que el juez manifieste el impedimento, ordenará pasar el proceso al juez o magistrado a quien corresponda conocer del asunto. Si el juez o Magistrado a quien se pase el expediente hallare fundado el impedimento, aprehenderá el conocimiento. Si lo considerare infundado, enviará el expediente al juez o magistrado inmediatamente superior, quien decidirá de plano la cuestión en fallo motivado. Si el Superior juzgare fundada la causal, remitirá el proceso al juez que debe reemplazar al impedido; si la considerare infundada, devolverá el proceso al juez que se había abstenido, para que siga conociendo de él.
