El artículo 40 del Decreto 1151 de 1989, quedará así: “Artículo 40. Competencia para imponer la sanción. La sanción de destitución sólo será decretada por el Ministerio de Justicia, previo concepto del Director General de Prisiones. Las sanciones de amonestación severa, multa o suspensión, sólo podrán ser impuestas por los Directores de Establecimientos Carcelarios al personal de planta, en comisión o radicación. El Director General de Prisiones las aplicará cuando aquéllos se encuentren legalmente impedidos para hacerlo”.
