En cualquier tiempo y ante el mismo Juez que conoció del juicio y a continuación de lo actuado, puede el alimentante demandar al alimentario para que se declare extinguida la obligación, o para que se varíe la forma de pago, o su cuantía y lo mismo puede hacer el alimentario sobre los dos últimos puntos.

A dicha demanda se le da curso en la forma establecida en los artículos anteriores.

La apelación de la sentencia se concede en el efecto suspensivo.
