El delincuente sorprendido en flagrancia podrá ser aprehendido y llevado ante el juez por cualquier persona. Si los agentes de la autoridad lo persiguieren y se refugiare en su propio domicilio, podrán penetrar en él, para el acto de la aprehensión; si se acogiere a domicilio ajeno, deberá preceder requerimiento al morador.
