Una vez en firme y ejecutoriada la sentencia judicial que determina la comisión de delitos contra la Administración pública o de cualquiera de los delitos contemplados en el literal j) del artículo 8º de la Ley 80 de 1993, se hará exigible por parte de la Administración la cláusula penal pecuniaria.
