Expirado el término de pruebas y el que se hubiere concedido para practicar las pedidas, lo informará el Secretario. Dentro de cinco días el Juez fallará.

En el caso de este artículo, la negativa por falta de prueba no causa ejecutoria, salvo que el Municipio haya pedido a su vez que se le dé a él la posesión efectiva de la herencia.
