Para que una empresa comunitaria que se transforme en sociedad comercial pueda acogerse a los beneficios de que trata el presente Decreto, deberá solicitar al INCORA ser calificada como tal mediante resolución motivada.

Parágrafo

Los requisitos y condiciones para que una empresa comunitaria sea calificada como tal, se establecerán en el reglamento que mediante acuerdo adopte la Junta Directiva del INCORA, el cual debe ser aprobado por Resolución ejecutiva.
