° Declaración judicial de vacancia. Las sentencias que dicten los Jueces Civiles del Circuito, de conformidad con lo previsto en los artículos 15 y 16 de la Ley 78 de 1986, declarando la vacancia del cargo de Alcalde por abandono del mismo, una vez en firme, deberán comunicarse con copia íntegra de su texto, al Presidente de la República, Gobernador, Intendente o Comisario, según el caso, a efecto de que se designe o encargue a quien deba reemplazarlo y cuando haya lugar se convoque a elección para designar al titular.
