Que tratándose de los requisitos de procedibilidad contenidos en el artículo 2º, numerales 3, 4 y 5 del Decreto 1059 de 2008 su cumplimiento será valorado por las autoridades judiciales competentes una vez realizada la postulación por parte del Gobierno Nacional a través del Ministerio del Interior y de Justicia dentro del marco de la Ley 975 de 2005 y sus decretos reglamentarios.
