Los pensionados tanto civiles como militares tienen el deber de dar cuenta al Ministerio del Tesoro cuando acepten empleo público remunerado, ya sea nacional, departamental o municipal. La contravención a este mandato implica la pérdida de la pensión por un tiempo igual al doble del que hubiere ejercido el empleo; y si el agraciado hubiere cobrado a u mismo tiempo el sueldo y la pensión, quedará extinguida la pensión.
