No habrá lugar al pago de la indemnización establecida en el artículo 23, en el evento de que se cause en favor del empleado el derecho a la pensión de invalidez a que se refiere el Capítulo XII de este Decreto.

Tampoco habrá lugar al reconocimiento y pago de la referida indemnización, en el caso de que el accidente de trabajo se haya producido por culpa grave o intencional de la víctima, o provocación deliberada e intencional suya.
